This electronic record is generated by a computer system and does not require any physical or digital signatures.

This document is published in accordance with the provisions of Rule 3 (1) of the Information Technology (Intermediaries guidelines) Rules, 2011 that require publishing the rules and regulations, privacy policy and user agreement for access or usage of www.ledmarket.in website by both vendors and buyers (hereinafter referred to as “Users”). These “Terms and Conditions” are binding on the Users and by using the website www.ledmarket.in and clicking “I Agree” the users hereby have voluntarily agreed to be bound by these terms and conditions.

About Us:

The Application and the website at www.ledmarket.in (“Website”) (collectively, “Portal”) are operated by Lumino Click Innovations Private Limited (“We/Us/Our/Company”).

 

Who we are:

We are an e-commerce start up engaged in the business of offering online LED Lights & Products to retail shops, distributors, manufacturers and consumers. We also offer business-to-business solutions to retail merchants of LED lights and other electric products. We further provide variety of LEDs, raw materials, and LED lights, which retail merchants can buy on our portal/website i.e., LEDmarket.in at wholesale prices, saving them time and money. Retail Merchants may receive superior products at wholesale prices using our technological portal, restoring consumer satisfaction and stimulating repeat sales.

 

  • Our role is limited to the managing application/portal and associated marketing, facilitating payment collections, fulfilment, order management, enquiry management and other incidental services to enable the transactions between the Suppliers and the Reseller (“Services”). LEDmarket.in portal only acts as a facilitator and service provider for the reseller facilitating delivery or other service related to an order. We do not have any control nor do we determine or advise or in any way involve itself in the offering or acceptance of such commercial/contractual terms between the reseller and its end user/consumer.
  • Please print a copy of this Agreement for your records and read the terms and condition and privacy policies of this Agreement before registering your account and/or providing any additional information to the Website.
  • By accessing the Website, you consent and acknowledge to have understood and agreed to be bound by the terms and conditions of this Agreement.
  • This Agreement shall be binding upon and inure to the benefit of the parties hereto and their respective heirs, successors and assigns. This provision shall survive termination of this Agreement.
  • By impliedly or expressly accepting these Terms, you also accept and agree to be bound by Privacy Policy available at LEDmarket.in, which may be amended from time to time. Our Privacy Policy outlines how is your information processed amongst other things.
  • The terms and conditions are subject to change any time, effective upon posting on the company website, and your use of the Service after such posting will constitute acceptance by you of such changes. Such change shall be notified by posting an updated version of the Agreement on this page.
  • This document and the privacy policy is an electronic record in terms of Information Technology Act, 2000 and rules there under as applicable and the amended provisions pertaining to electronic records in various statutes as amended by the Information Technology Act, 2000. These ‘Terms of Use’ constitute an electronic record within the meaning of the applicable law. This electronic record is generated by a computer system and does not require any physical or digital signatures.

Applicability:

The terms and conditions narrated below governs the use of the Website and content thereof including text, data, information, photographs and applies to the sale of the products by us through its website LEDmarket.in (hereinafter referred to as the “the Website”) unless omitted and/or superseded by a written instrument duly accepted by us. The provision of making available the products for sale though the website shall be collectively referred to as “the Services”.

By placing an order, the User/Visitor are offering to purchase Services on and subject to the following terms and conditions. All orders are subject to availability and confirmation of the order price. Dispatch times may vary according to availability and subject to any delays resulting from postal delays or force majeure elaborated below for which we will not be responsible.

 

We intend to provide the Services across Pan India. We  do not intend to provide Services or any part of the Services thereof through its website to any individual/ organisation outside the country of India, and are governed by Indian laws only. The products are provided “as is” and “as available” basis without any representation or warranties, express or implied except otherwise specified in writing. We assume no liability whatsoever for any illegal items shipped by any vendor/supplier registered with our portal.

 

Collection of Information and reasons for such collection:

In order to provide Services effectively, we require certain type of information including but not limited to the following

We do not access your Aadhar card or collect copy of the same and hence do not store any sensitive personal data or information.

When you access the Services online, our web servers also automatically create records of your visit. These records typically include IP-address, access times, the sites linked from, pages visited, the links and features used, the content viewed or requested, browser or application type, language and other such information (Log Data). We use Log Data to provide our Services and to measure, customize, and improve them, as well as collect and use them in the aggregate.

The information provided is stored at servers located in India. The Users/Visitors consents to the storage of data in such location.

 

We use the information we collect to carry out our contractual commitments towards the Users/Visitors. In addition, we process Personal Data to comply with legal obligations and to help you find the most relevant information for your situation by customizing our Services to optimize your experience and fulfil delivery of such Services.

Payment Method and Disclaimer:

 

Since we only act as facilitators, we may, at the request of the supplier or the reseller, act as the payment agent for the limited purpose of accepting payments on behalf of such suppliers and resellers. The Users understands, accepts, agrees and acknowledges that the payment facility provided by us is neither a banking nor financial service but is merely a facilitator providing a third-party payment processor for the transactions on the Application.

Further, by providing payment facility, we are not in any manner acting as a trustee nor acting in a fiduciary capacity with respect to the transaction or the transaction price. We shall not under any manner be liable for any charges made by the Users bank in relation to payment of the total amount.

In connection with any order, information such as name, billing address and credit card information will be required us or the third-party payment processor. If the Users are directed to the third-party payment processor, they may be subject to terms and conditions governing the use of that third party’s service and that third party’s personal information collection and processing practices. Users are requested to review such terms and conditions and privacy policy before using the Application. In case of Reseller providing billing information, delivery address or other contact information of its end user/consumer to Company or other delivery service provider, Reseller shall ensure that it has necessary consents and approvals from the respective end user/consumer as may be required under applicable law. Company merely collects the payment on behalf of the Supplier or Reseller, as the case may be. All applicable taxes and levies, the rates thereof and the manner of applicability of such taxes are to be charged and determined by the Supplier or Reseller. Company holds no responsibility for the legal correctness/validity of the levy of such taxes. The sole liability with respect to any legal issue arising on the tax’s payable shall be with the Reseller. The transaction is bilateral between Suppliers & Users and/or Reseller & end users/consumers (“User Transactions”), the Company is not liable to charge or deposit any taxes applicable on such transaction.

NOTE: ANY TRANSACTIONS DONE WITH SUCH THIRD PARTY SHALL BE AT THE USERS OWN RISK WITHOUT ANY RECOURSE TO THE COMPANY.

Pricing and Availability:

While we attempt and ensure that all details, descriptions and costs which show up on the Website are precise, mistakes and errors might happen. Assuming we find a blunder in the cost of any Service which you have requested, we will inform you regarding this straightaway and provide you with the choice of reconfirming your order at the right cost or dropping it. On the off chance that we can’t reach you we will regard the request as dropped. Assuming you cancel after having effectively paid for the Services, you will get a full refund.

We shall initiate processing of respective orders upon successfully receiving the payment respective orders placed. Delay in Delivery could possibly arise in the event inaccurate details are provided. We do not assume liability of any manner whatsoever for delay attributable for such reasons. Users/Visitors are advised to provide accurate billing information in order to avoid any delay in delivery.

We shall make every endeavour to deliver the Services within the agreed time frame. The User/Visitor are required to accept the delivery of Services without any objection as long as the Services are delivered without material physical damage. If the delivery is not accepted for any other reasons except the above, we shall be entitled to levy cancellation charges as applicable.

We do not deliver directly to users and  delivery partner is involved for the same. Any damages to products in delivery and any issues pertaining to the same will be directly addressed by them by connecting with them on their respective customer care.

 

Shipping charges are to be borne by the Supplier and can be determined by him with our shipping partner having registered office at ___________and website___________.

 

Return/Refund Structure:

Buyer may request replacement for items they buy from sellers and suppliers listed on the Portal that are within the return window by providing Reference Order id, item code, invoice copy and defect pictures. However, products on our portal are explicitly identified as ‘NOT RETURNABLE’ on the product detail page cannot be returned/refunded/replaced. All replacements are subject to other Sections of this terms and conditions.

However, if buyer receives a damaged/defective/wrong product from any seller listed on the Portal, the User will still be allowed replacement.

Subject to seller’s replacement policy provided on the product description, the User will be allowed to replace an already purchased product.

The user will be eligible for replacement of the product if the product received is defective, damaged, wrong or incomplete due to seller’s fault or if the user has received the wrong product.

Replacement Guidelines:

The products available on the Portal are usually replaceable within 3 of delivery subject to specific details in relation to each product as mentioned in the product description. Any replacement or exchange request must be raised within the return window period specified on the product detail page.

For the replacement to effectively take place, the product must be eligible for the return and it is imperative for the buyer to ensure that the product:

  1. must be in its original condition with all the packaging including brand/manufacturer’s box/packaging, tags, warranty cards and other accessories intact;
  2. must not be damaged in your possession;
  3. must be unused, unwashed, unsoiled, without any stains and with non-tampered quality check seals/return tags/warranty seals (wherever applicable).
  4. must not be used or altered;
  5. must be the same product that was delivered to you; and
  6. must be returned within the return window specified against a product on the product detail page.
  7. IMEI/ name/ image/ brand/ serial number/ article number/ bar code of the returned product should match the records of ledmarket.in. Any additional conditions provided in the product details against each product shall be applicable as well.

 

If the return is not eligible for pickup, a return option will not be available.

In the event the User intends to return an electronic device, then it must ensure that personal information, must be remove/deleted prior to returning and such electronic device should be formatted, and screen lock should be disabled.

NOTE:

  1. REPLACEMENT OR EXCHANGE IS SUBJECT TO STOCK AVAILABILITY AND SUBJECT TO YOUR ADDRESS BEING SERVICEABLE FOR REPLACEMENT OR EXCHANGE.
  2. NO REPLACEMENT OR EXCHANGE SHALL BE ACCEPTED IF WARRANTY CARD, AND OTHER REQUISITES ARE MISSING WHILE REPLACEMENT OR EXCHANGE OF PRODUCT.

In the usage of our portal, all commercial/contractual terms of sale are offered by Sellers and agreed to between Sellers and the Buyers alone. The commercial/contractual terms include without limitation, price, date, period and mode of delivery, warranties related to products, etc. Our role is limited to the managing application/portal and associated marketing, facilitating payment collections, fulfilment, order management, enquiry management and other incidental services to enable the transactions between the Suppliers and the Reseller (“Services”). We do not have any control and do not determine or advise or in any way involve ourselves in the offering or acceptance of such commercial/contractual terms between the sellers and the buyers. Policies related to returns/ exchanges, penalties, refunds, cancellation will be updated in the Application from time to time. We hold the right to change these policies as required in the Application without any permission from the Users/Buyers or Sellers. There is a commission charged by our portal to the seller on every product sold by them on our portal.

 

Service Charges:

Services availed by users on our Portal may require payment of charges, rate of which shall be solely at our discretion and shall be subject to User approval at the time of placing an order on the Portal. We reserve the right to revise charges towards Service at any time at our sole discretion. The charge, applicable at any given time, will be the charge displayed at the time of purchase/booking of the respective Service (if any) by User on the Portal.

We reserve the right to introduce additional chargeable services on the Portal including charges for a premium return service, cancellation charges, cash on delivery handling fees etc.

We charge commission to the seller on every of their product sold on our portal and that constitutes our major revenue model.

  

Offers and benefits provided on the Portal:

It is pertinent for users to make note that, subject to the below, all product discounts and offers are by the Suppliers and not by the Company.

From time to time, we may conduct various types of marketing and promotional campaigns which may include offers, discounts and other promotional offers to be used on our portal. Such offers shall be subject to the terms and conditions which are solely determined by us, and the terms of such discounts and offers may vary for the customers based on factors relating to the customer such as usage of the portal, volume of transactions, time spent on the portal, city, place of residence, time, etc. We reserve the right to void, discontinue, cancel or reject the use of any of the offers, discounts or promotional offers without any prior intimation. The offers, discounts and promotional offers cannot be exchanged for cash and can only be availed in accordance with the terms and conditions of the offers, unless otherwise communicated. Certain offers, discounts and promotions offered such as first order discount, reactivation discount etc., may be applied at the cart level and in the event that multiple products are purchased in a single transaction, then such offer, discount, promotion may be divided and applied to each product in the cart, in a manner determined by us.  Subject to portal Cancellation and/or Return, Refund and Replacement policy, if the User: (i) cancels any product which is subject to any promotions, offer or discounts; or (ii) returns any product purchased which is subject to any promotions, offer or discounts, the User will be eligible to receive only the refund of the amount paid by the User on the purchase of such product.

We  have no liability with respect to the offers, discounts and promotional offers on the Portal.

 

 

 

USE OF THE PORTAL

We endeavour to make the Application available 24X7 for users. However, we do not represent that access to the Application will be uninterrupted, timely, error free, free of viruses or other harmful components or that such defects will be corrected.

Users understand and acknowledge that the use of Application requires internet connectivity and telecommunication links. Users shall bear the costs incurred to access and use the Application and avail Services, and Company shall not, under any circumstances whatsoever, be responsible or liable for such costs.

We do not warrant that Application will be compatible with all hardware and software which is used by Users. Application may be under constant upgrades, and some functions and features may not be fully operational. Application is provided on an ‘as is’ and ‘as available’ basis. We expressly disclais all warranties of any kind, whether express or implied with respect to the records and other data that is made available by it to Users. Users shall be solely responsible for damages to their data system or for loss of data arising from download of content from Application. No guidance or information, written or oral, obtained from us or via Portal, shall constitute any warranty, unless stated otherwise.

 

Performance Guarantee

We, through our Portal, are mere facilitators of the transaction including between Suppliers and Buyers and are not responsible for any non-performance or breach of any contract entered into towards User Transactions. We do not guarantee that the concerned Suppliers will perform any transaction concluded on the Portal. We do not undertake to mediate or resolve any dispute or disagreement between the Users concerned including with any other third party.

We do not represent any of the buyers or Suppliers, and disclaim any liability with respect to any error or inconsistency with respect to any information relating to such Supplier or buyer displayed on the Portal.

We do not make any representation or warranty as to the item-specifics (such as legal title, creditworthiness, identity, etc.) of any of its Users , and shall not be liable for any misuse of information shared by Users with it; or through the Users profile; or with a third party on the Portal, chat rooms, forums, or comments. Users acknowledge and agree that we are not an arbitrator or judge of disputes concerning intellectual property and it cannot, by any means, verify that any Supplier or Reseller selling or supplying merchandise on/through the Portal have the right to sell the products. Company encourages Users to assist it in identifying listings on the Portal, which, according to the Users’ knowledge or belief infringe their rights or third party rights. We do not at any point of time during any transaction between any Supplier and a buyer take possession of any product offered nor do we at any point gain title to or have any rights or claims over such products. At no time do we hold any right, title or interest over the products nor shall we have any obligations or liabilities in respect of such contract entered into between the Users. We are not responsible for damages or delays as a result of products which are out of stock, unavailable or back ordered.

 

 

ACCURACY AND COMPLETENESS OF INFORMATION ON PORTAL

 

We take all endeavours to the best of our efforts to keep information on the Portal accurate. However, the material and content on the Portal is provided for general information only and should not be relied upon or used as the sole basis for making decisions without consulting primary, more accurate, more complete or timely sources of information. User will agree that a majority of content including products displayed on Portal are provided by the respective Suppliers, who shall at all times be responsible for provision of information related to such products listed by them. Apart from reasonable checks to ensure general hygiene of Portal, we do not exercise any control over such content or information. We have no obligation to update, amend or clarify information in the Portal, including without limitation, pricing information, except as required by law. We do not own any responsibility or obligation whatsoever towards either ensuring the accuracy of the information provided by the Users. Any reliance on the material on the portal is at the Users’ own risk.

The portal may contain certain historical information. Historical information, necessarily, is not current and is provided for your reference only. We reserve the right to modify the contents of the portal at any time, but have no obligation to update any information. User is solely responsible to monitor changes to the information on Portal. No specified update or refresh date applied to Portal, should be taken to indicate that all information on Portal or pertaining to the Services have been modified or updated. Occasionally there may be information on Portal that contains typographical errors, inaccuracies or omissions that may relate to information pertaining to the products, pricing, promotions, offers, shipping charges, transit times and availability. Company reserves the right to correct any errors, inaccuracies or omissions, and to change or update information if any information on Portal is inaccurate at any time without prior notice.

 

Information related to products on Portal provided by the Company

Not all information on the Portal is provided by Company. From time to time, Users who are Suppliers, also provide information relating to the products proposed to be sold by them and are hence are responsible for the same. In this connection, Suppliers undertake that all such information shall be accurate in all respects. Suppliers are discouraged from and should not exaggerate or overemphasise the attributes of such products so as to mislead Users in any manner. We reserve the right, but have no obligation, to monitor the materials posted on Portal. We, however, have the right to remove or edit any content that in our sole discretion is violative, or is alleged to violate, any applicable law or either the spirit of these Terms. In no event shall we assume any responsibility or liability for any content posted or for any claims, damages or losses resulting from use of content and/or appearance of content on our portal. Suppliers take sole responsibility for the correctness of the details pertaining to specifics (such as quality, value, saleability, etc.) of the products proposed to be sold or offered to be sold or purchased on Portal. We do not implicitly or explicitly support or endorse the sale or purchase of any products nor provide any warrantee/guarantee of the products sold to Buyers, and in no event shall such products be the responsibility of our Company. We do not represent or warrant that the product information available on portal will be correct, accurate or otherwise reliable. Principle of law of Buyer Beware is applicable, whereby a buyer is expected to exercise his own due diligence with respect to the product and seller. We are not responsible for any inaccuracy, incompleteness or outdated information made available on the portal, either provided by any User including Suppliers.

 

 

 

INTELLECTUAL PROPERTY (IP) AND IP INFRINGEMENT

Users of the portal undertake not use any trademark, service mark or logo of any independent third parties without prior written approval from such parties.

“LEDmarket.in” and related icons and logos whether registered or unregistered are the trademarks of the Company and are protected under applicable copyright, trademark and other proprietary and intellectual property laws. Users’ unauthorized adoption copying, modification, use or publication of these marks is strictly prohibited. Users by accepting these terms and conditions agree not to modify the paper or digital copies of any materials printed or downloaded in any way, and they must not use any illustrations, photographs, video or audio sequences or any graphics separately from any accompanying text. Users must not use any part of the materials on the portal for commercial purposes without obtaining a licence to do so from the Company. All rights, not otherwise claimed under this Agreement by Company are hereby reserved.

 

Advertisement

Advertisements on our portal are solely intended to provide general information for the personal use of the user(s). The Company does not represent, warrant or endorse in any manner the accuracy or reliability of the Advertisements. Our  Company and portal accepts no responsibility or liability in relation to the Advertisements including without limitation on account of usage or reliance placed by users on such Subject Information. The correspondence or business dealings of Users with, or participation in promotions of, advertisers found on or through the Portal, including payment and delivery of related products or services, and any other terms, conditions, warranties or representations associated with such dealings, are solely between the User and such advertiser. The Company and portal shall not be responsible or liable for any loss or damage of any sort incurred as the result of any such dealings or as the result of the presence of such advertisers on the Portal

 

The User shall not hold the Company responsible and the Company disclaims any liabilities, losses, damages, expenses, claims or injury arising out of or in connection with: (i) the advertisements displayed on Portal; (ii) contents of the Advertisement; (iii) representations and statements made by the advertiser; (iv) subject matter of the Advertisements and the products/services referred thereunder (including without limitation on account of suitability, merchantability, reliability, availability or quality of the product/service); and/or (v) Advertisement being misleading and/or not in compliance with applicable laws.

 

Seller code of conduct

This Code of conduct requires that sellers registered on our portal act fairly and honestly on LEDmarket.in to ensure a safe buying and selling experience. All sellers hereby agree to by usage of the portal, to unconditionally comply with the following:

  • Provide accurate information to LEDmarket.in and customers at all times
  • Act fairly and not misuse LEDmarket.in features or services
  • Not attempt to damage or abuse another Seller, their listings or ratings
  • Not attempt to influence customers’ ratings, feedback, and reviews
  • Not send unsolicited or inappropriate communications to buyers.
  • Not contact customers except through Buyer-Seller Messaging
  • Not attempt to circumvent the LEDmarket.in sales process

Sellers undertake not to circumvent the LEDmarket.in sales process or divert LEDmarket.in customers to another website. This means that sellers either on product posting or messaging will not provide links or messages that prompt users to visit any external website or complete a transaction elsewhere.

  • Not operate more than one selling account on LEDmarket.in without a legitimate business need
  • Not engage in conduct that violates price fixing laws

Violating the Code of Conduct or any other LEDmarket.in policies may result in actions against your account, such as cancellation of listings, suspension or forfeiture of payments, and removal of selling privileges. More details about these policies are below.

  • Not to misuse Customer Information

Sellers receiving customer information such as addresses or phone numbers to fulfil orders, undertake to use that information only to fulfil orders and must delete it after the order has been processed. You agree not use customer information to contact customers (except through Buyer-Seller Messaging) or share it with any other third-party.

  • Code related to Seller Returns, refunds, cancellations, and claims

It is mandatory for sellers to respond to customer requests for refund within 24 hours. To avoid a negative customer experience, the sellers undertake to actively monitor the refund to ensure that it is issued to the buyer in a timely manner of 7 working days. Sellers undertake to process a return when they have received a return request from a buyer, a returned shipment, or have arranged to refund a purchase.

If a buyer asks for an order cancellation, and it is not yet shipped and confirmed the shipment, the seller can cancel it in manage orders section of the portal or use an Order Cancellation feed.

 

Seller Payment withdrawal

Generally, we first settle Seller account balance in 14 days after the seller registers their  seller account. This means that we will initiate a payment to your bank account on your settlement date. LEDmarket.in sends the money to your bank account using an Automated Clearing House (ACH) or electronic funds transfer. It can take up to five business days for the money to appear in your bank account after LEDmarket.in initiates a payment.

Before the portal can pay the seller, the seller must provide a valid bank account as the Deposit Method in their seller account settings. Payments cannot be made to a credit card or online payment system, such as PayPal.

 

Membership Eligibility

Use of the Website is available only to persons who can form legally binding contracts under Indian Contract Act, 1872. Persons who are “incompetent to contract” within the meaning of the Indian Contract Act, 1872 including minors, un-discharged insolvents etc. are not eligible to use the Website. www.curveia.com reserves the right to dishonour your order and refuse to provide you with access to the Website if it is brought to the Company’s notice or if it is discovered that you are under the age of 18 years.

(i) Business entity: If you are ordering as a business entity, you represent that you are duly authorized by the business entity to accept this User Agreement and you have the authority to bind that business entity to this User Agreement

 

 

Your Consent

By using the Website and/or by providing your information in the order form , you consent to the collection and use of the information you disclose on the Website by  the Company in accordance with Privacy Policy.

Payments for items on the Website can be made through Online Payment Facility which also enables automated collection and remittance services. Using the current Internet banking and credit/debit/cash /card cheque and such other infrastructure directly through Bank or financial institution infrastructure or indirectly through Payment Aggregator or through any facility as may be authorized by the Reserve Bank of India for collection, refund and remittance, as the case may be of payment or supporting the same in any manner.

After receiving order form from a User, we send an email to the user along with the details for payment of fees via email, and the products or services are provided to the User only post receipt of the Payment and confirmation of the same shared by the Company with the User via email.

All prices posted on this website are subject to change without notice. Prices prevailing at commencement of placing the order will apply. Posted prices do includes all taxes and charges. In case there are any additional charges or taxes the same will be mentioned on the website.

Breaches & Termination

Without limiting other remedies, the Company may limit your activity, immediately temporarily/indefinitely suspend or terminate or block your usage of the website, and/or refuse to provide you with access to the Website in the event, but not limited to:

(a) If you breach the User Agreement or Privacy Policy or the terms and conditions of the Website;

All purchases on the Website are a firm commitment to purchase. Governing Laws, Jurisdiction and Dispute Resolution:

The arbitration proceedings shall be in accordance with the Arbitration and Conciliation Act, 1996 or any enactments in substitution thereof. The award of the arbitrator shall be final and binding upon the Parties and non-appealable and the Parties agree to be bound by the same and the success of obligation the Company.

We continuously strive to update and upgrade its services by taking into account the Users/Visitors feedback. We therefore provide assistance and guidance through its customer care representatives. When communicating with our customer care representatives (whether over the telephone, or via email or letter), you agree to not be abusive, obscene, profane, offensive, sexist, threatening, harassing, racially offensive, or to not otherwise behave inappropriately. Additionally, fulfilment of orders to their end users/consumers by Reseller shall be the responsibility of the Reseller inter se such end user/consumer. Any add-on service provided by Portal towards such order shall be provided merely as a service provider of such Reseller by the Portal and accordingly, Portal shall not have any privity of contract with such end user/consumer.

Application may be under constant upgrades, and some functions and features may not be fully operational. Application is provided on an ‘as is’ and ‘as available’ basis. Company expressly disclaims all warranties of any kind, whether express or implied with respect to the records and other data that is made available by it to Users.

Users acknowledge and agree that the Company is not an arbitrator or judge of disputes concerning intellectual property and it cannot, by any means, verify that any Supplier or Reseller selling or supplying merchandise on/through the Portal have the right to sell the products. Company encourages Users to assist it in identifying listings on the Portal, which, according to the Users’ knowledge or belief infringe their rights or third party rights.
